This notice describes our privacy policy for the website www.thinkoutsideboxes.com (the “Site”) of Think Outside LLC (“Think Outside”, “Company”, “we”, “us”, and/or “our”) and related Services. This Privacy Policy sets forth Think Outside’s policy with respect to information including personally identifiable data (“Personal Data”) and other information that is collected from visitors to the Site and Services. This privacy policy covers only information that is collected through the Site and does not cover websites to which we link. By submitting Personal Information through our Site or Services, you agree to the terms of this Privacy Policy and you expressly consent to the collection, use, and disclosure of your Personal Information in accordance with this Privacy Policy.
A. WHAT INFORMATION DO WE COLLECT?
We will not sell or disclose your name or email address to third parties without your explicit consent, except as specified in this privacy policy. We collect Personal Data from you when you voluntarily provide such information, such as when you contact us with inquiries, respond to one of our surveys, register for access to the Services, or use certain Services. Think Outside may collect Personal Data when you register for a contest or other promotion on the Site (together, “Promotions”) to administer the Promotion and, to the extent permitted by law, for marketing purposes, including sharing such Personal Data with third parties involved with the Promotion (e.g., prize providers) for their marketing purposes. Wherever Think Outside collects Personal Data, we make an effort to provide a link to this Privacy Policy. When you subscribe to Think Outside, we collect non-personal information such as your age, gender, and other demographic information. We use this information when considering future products to include in our service, evaluate the performance of our site, and to generate anonymous statistics on our subscriber base. Think Outside automatically receives and records information on our server logs from your browser, including your IP address, cookies, and the pages you request. In order to use some Services, you may be required to complete the applicable registration form accessible on the Site. All persons who register are referred to as “Registered Users.” Some Services may not require registration. We collect and maintain records of all data provided through such registration forms, e.g. your name, e-mail, mailing and billing addresses, passwords; this also includes information about your child, e.g., your child’s name, birthday, interests, and gender. For example, individual users who desire to order a Product (as defined in the Terms of Service) must provide certain contact information, shipping information, billing information, and financial information (e.g., a credit card number and expiration date), which will be collected by us or our third party payment processing service providers. For some Services, each Registered User may be provided a unique username and password that enable access to the Service. We may track the use of those usernames and passwords in order to collect and maintain records of individual transactions conducted through the Services by Registered Users, and those records may be associated with each Registered User’s individual account profile within the Company system. We also collect other types of Personal Information that you provide to us voluntarily, such as your operating system and version, product registration number, and other requested information if you contact us via email regarding support. We also collect and maintain records of information that you voluntarily provide to us. For example, we may ask you to participate in a survey, and may ask you to provide Personal Information, such as age, gender, or other demographic data. If you enter into a contest or promotion on our Site, we will collect the information you provide to participate in the contest or promotion. If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the email, in order to send you a reply. When you post messages on the message boards of our Site or social media accounts, the information contained in your posting will be stored on our servers and other users will be able to see it. However, unless such information is necessary for the Service or required by the Terms of Service, we do not require you to provide such information to us.
B. LOG FILES
Like most websites, we automatically gather certain information about our Site traffic and store it in log files. This information includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information, which does not identify individual users, to analyze trends, to administer the Site, to track users’ movements around the Site, and to gather demographic information about our user base. We do not link this automatically collected data to personally identifiable information.
C. COOKIES
A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on our website. As noted above, we do not link the information we store in cookies to any personally identifiable information you submit while on our site. This privacy policy covers the use of cookies by the Site only and does not cover third party websites that we may be linked to. Some of our business partners (e.g., advertisers) use cookies on our site. We have no access to or control over these cookies.
D. SERVICE-RELATED ANNOUNCEMENTS
We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.
E. CUSTOMER SERVICE
Based upon the personally identifiable information you provide us, we will send you a welcoming email to setup your account. We will communicate with you in response to your inquiries, to provide the services you request, and to manage your account. F. ID AND ADDRESS VERIFICATION
We use a third party to verify your identity and address for shipping purposes.
G. GOOGLE ANALYTICS
We may allow third party service providers to use cookies or similar technologies to collect information about your browsing activities over time and across different Websites following your use of the Services. For example, we use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help us analyze how users use the Site and enhance your experience when you use the Service. H. USE AND DISCLOSURE OF COLLECTED INFORMATION
Think Outside uses information for the following general purposes: products and services provisioning, billing, identification and authentication, services improvement, contact, research, and anonymous reporting. IP addresses are automatically reported by your browser each time you view a web page. Your IP address is stored in Think Outside’s user registration databases when you register with Think Outside. IP addresses may be used for various research purposes, and/or delivering unique functionality to our service. We also use information collected through the Site and the Service to communicate with Registered Users from whom such information was collected in order to provide promotional materials about us. However, unlike communications which are necessary to provide Services, promotional communications are optional, and we will refrain from sending that kind of information to you if you inform us that you prefer not to receive them, as described in more detail below. We use Non-Personal Information in a variety of ways, including, but not limited to, evaluating the performance of the Site and Service and the general preferences of users, or to generate anonymous statistics for our benefit or for our business partners. Because Non-Personal Information is entirely anonymous, and therefore can never be used by us to identify you, this policy does not limit our ability to use or disclose Non-Personal Information. We may create Non-Personal Information records from Personal Information by excluding information (such as your name) that make the data personally identifiable to you. If we collect information through the Site and/or the Service that you provide to us voluntarily through online forms, social media outlets, surveys, email communications, or by other means, we will treat that information as described above, as applied to both Personal Information and Non-Personal Information. As mentioned above, Company may use and disclose Non-Personal Information without restriction. It is the policy of Think Outside to provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to users via email notice, written or hard copy notice, or through conspicuous posting of such notice on the Site, as determined by Company in its sole discretion. Think Outside reserves the right to determine the form and means of providing notifications to our users. By providing Think Outside with your email address, you consent to us using such email address to send you notices in lieu of postal mail. We may also use your email address to send you other messages, including changes to Think Outside features and special offers. You may opt out of certain notifications by sending an email to support@ThinkOutsideBox.com. Opting out may prevent you from receiving email messages regarding updates, improvements, or special offers, and you may not opt out of certain types of notices, including but not limited to announcements regarding certain products, support of the Site, and other notices as may be required by law (also see Section D above). If you or we have provided any third party with your information, you will have to contact such third-party directly with any opt-out request. We do not maintain responsibility for the manner in which third parties use or further disclose Personal Information collected from you through the Site or Services, after we have disclosed that information to those third parties. However, we do require our third-party service providers to promise not to use such information except as necessary to provide the relevant services to us. J. ACCESS TO PERSONAL INFORMATION COLLECTED FROM YOU
Registered Users may access their Registration Profiles at any time to update Personal Information contained within that Registration Profile. Subsequent uses or disclosures of information by us will reflect those changes, but we have no ability to update any information previously disclosed to any third party. You may request deletion of your Personal Information by us, but please note that we may be required to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives. The Site has security measures in place to protect against the loss, misuse, and unauthorized alteration of Personal Information in Company’s possession and control. For example, whenever the Service requests that Registered Users provide sensitive information, that information is encrypted with industry standard encryption techniques. When you are viewing a secure page within the Site, such as our checkout form, an icon of a padlock will appear as “locked” at the bottom of web browsers such as Google Chrome, but the same icon will appear as “unlocked” when the user is merely “surfing.” We currently use an encryption program known as “SSL,” or “Secure Sockets Layer.” To learn more about SSL, go to https://www.ssl.com. Credit card authorization requests are sent using the same encryption technology. Please be aware that, although we endeavor to provide security for information in our possession and control, no security system can prevent against all potential security breaches, and we bear no liability for uses or disclosures of Personal Information or Non-Personal Information arising in connection with the theft thereof. Likewise, Registered Users are responsible for safeguarding the confidentiality of passwords to any Services, and we bear no liability for access to, or use or disclosure of, Personal Information, if such access, use or disclosure arises in connection with the theft or disclosure (whether intentional or negligent) of a password. K. CHANGES TO THIS POLICY
If we change our Privacy Policy, we will post those changes on the Site so that users are always aware of what information we collect, how we use it, and under what circumstances, if any, we will disclose it. Any changes will be effective upon the earlier of thirty (30) calendar days following our dispatch of an email notice to you or thirty (30) calendar days following our posting of notice of the changes on our Site. These changes will be effective immediately for new users of our Service. In any event, changes to this Privacy Policy may affect our use of Personal Information that you provided us prior to our notification to you of the changes. If you do not wish to permit changes in our use of your Personal Information, you must notify us prior to the effective date of the changes that you wish to deactivate your account with us.
